    • Sentences are punishments for convicted defendants. Prescribed punishments for crimes can be found in state and federal statutes. The Eighth Amendment places limits on the severity of punishments.

    • When issuing a sentence in a criminal case, a judge has much discretion to prescribe penalties that are appropriate to the crime. Judges and jurors must follow basic criminal sentencing guidelines so as to avoid sentences that are unconstitutional.

    • A few months after the defendant is found guilty, they return to court to be sentenced. The judge receives guidance and assistance from several sources in order to sentence a defendant.

    • If you are found guilty or plead guilty, you will get your punishment from the judge. This is called sentencing. For violations and minor misdemeanor cases you may be sentenced right away.

    • Although there can be variations, there are basically 3 phases to a criminal case when a person is convicted or pleads guilty: (1) arrest; (2) conviction or a plea agreement; and (3) sentencing.

    • Different states throughout the country use different methods to calculate the sentences for people convicted in criminal court. In cases involving felony offenses, Florida uses the Criminal Punishment Code (CPC) as its sentencing guidelines.
