    Chapter 1: DWI/DUI/OMVWI Awareness Education

    • In Texas, both a DUI and a DWI refer to an individual operating a vehicle in a public place while intoxicated, which means he or she lacks the normal use of mental or physical faculties because of the use of alcohol or a drug.

    • The standard drunk or drugged driving offense in New York is called "driving while intoxicated" or "DWI." But New York also has a less serious offense called "driving while ability impaired" or "DWAI."

    • OWI is an acronym for operating while intoxicated, referring to a legal charge for drunken driving. For the most part, the acronym that indicates a drunk driving charge depends on the state in which you are driving.

    • Before the police can arrest you for DUI, they must have reason to believe that you were operating a motor vehicle while under the influence of alcohol. To help them justify the arrest, the police will probably ask you to perform field sobriety tests.

    Chapter 3: Blood Alcohol Level (BAC) and Legal Limits, How Much is Too Much?

    • While 0.08 is the BAC level that will result in a charge of DUI, DUII or DWI there are zero tolerance and enhanced penalty BAC levels that differ from state to state. Also note that the fines, fees and laws are different in each state.

    • You are legally intoxicated in Texas when your blood alcohol concentration reaches 0.08%, but you are breaking the law as soon as drugs or alcohol affect your driving — or flying or boating — ability.

    • How Many Drinks Does it Take to Reach 0.08 %BAC? You should never drink and drive, no matter how much you’ve consumed. You can be impaired and arrested even if your BAC is under 0.08%.
